Changes to data sharing resulting from the Client Data Act

Previously entered information will remain in force and act side by side with new Kanta information so that data sharing will not be compromised.

Clients must be given new Kanta information, but there is no need to start implementing new, so-called mass information for citizens in the healthcare service.

As from 1 November 2021, logging into My Kanta Pages will direct the client straight to the new information, and the client needs to accept it in order to enter the service. 

In the healthcare service, new information can be acknowledged as received when the patient information system used has implemented the service in question. In such a case, the patient data system also recognises if the client has already received Kanta information.

If there is a need to inform the client before the new Kanta information can be entered in the system, it can be entered in accordance with old information.

Social welfare service providers must deploy 

  • the client data archive for social welfare services for archiving social welfare client documents.
  • the system for issuing declarations of intent where the client’s declarations of intent documents related to Kanta information and sharing of client data are archived.

In addition, a social welfare service provider can deploy the Prescription service, if necessary.

A private social welfare service provider providing a service on behalf of a public social welfare service provider and a public service organiser must join as a user of the national information system services by 1 September 2024 at the latest.

A private social welfare service provider that is providing social services only privately, i.e. only on the basis of an agreement signed with the client, and that has an information system for the purpose of processing client data, must join by 1 January 2026 at the latest. 

The joining obligation will enter into force regardless of which services under the social welfare service task the service provider is producing.

According to the Client Data Act, after joining, the service provider must enter client documents produced in its operations in the archiving service. However, the start of the entry obligation has been staggered by service task with the Client Data Act transition provision.

In order to meet the obligation on archiving, the service provider must enter the documents in compliance with the THL regulation on the structures of client documents in social welfare services and the data entered in client documents. THL is due to issue the regulation by the end of 2021. 

The content and structure of client documents entered in the client data archive for social welfare services must comply with the client document structures published in the Sosmeta service at the latest when the client documents must be entered in the client data archive for social welfare services in accordance with the transition provision of the Client Data Act. Documents used in social welfare services and entered in the client data archive for social welfare services are described in the Sosmeta service (sosmeta.thl.fi, in Finnish).

The legislative amendment that entered into force on 1 November 2021 also enables showing of client data in social welfare services in My Kanta Pages. The showing of the data to citizens in My Kanta Pages requires that social welfare service providers start entering client data in the client data archive in social welfare services. Technical modifications are also required in both the Kanta Services and in the client data systems of social welfare service providers that enter the data. Information will be provided on the showing of client data in social welfare services in My Kanta Pages at the appropriate time.
